This Privacy Policy describes how EatFitGo Food Pvt Ltd (“EatFitGo”, “we”, “us”, or “our”) collects, uses, and discloses your Personal Information when you visit our website  (the “Site”), use our mobile application, place an order, or otherwise interact with our services.

By using the Site or placing an order with us, you agree to the practices described in this Policy.

1. Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and the information necessary to process your orders. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual as “Personal Information”.

Device information

  • Examples collected: web browser version, IP address, time zone, cookie information, products and pages you view, search terms, and how you interact with the Site.
  • Purpose: to load the Site accurately for you, and to perform analytics on Site usage so we can improve it.
  • Source: collected automatically when you access our Site, using cookies, log files, web beacons, tags, or pixels.
  • Disclosure for a business purpose: shared with our hosting and analytics processors.

Order and delivery information

  • Examples collected: name, billing address, delivery address, delivery instructions and landmarks, payment information (processed by our payment gateway), email address, and phone number.
  • Purpose: to prepare and deliver your food orders, fulfil our contract with you, process payments, arrange delivery, issue invoices and order confirmations, communicate with you about your order, screen orders for potential risk or fraud, and — where you have opted in — send you information or offers about our products and services.
  • Source: collected from you.
  • Disclosure for a business purpose: shared with our payment processors, delivery partners, and logistics providers to the extent necessary to complete your order.

Dietary and food preference information

  • Examples collected: dietary preferences (such as vegetarian, vegan, Jain, or eggless), allergen and ingredient avoidance instructions, calorie or nutrition goals, and meal-plan selections that you choose to share with us.
  • Purpose: to prepare meals that meet your stated requirements, to flag allergens to our kitchen and packaging teams, and to recommend items suited to your preferences.
  • Source: collected from you, voluntarily.
  • Note: you provide this information at your discretion. Please see Section 7 (Allergen Information) for important limitations.

Location information

  • Examples collected: delivery address, approximate device location where you grant permission, and service-area pin code.
  • Purpose: to confirm whether we deliver to your area, to estimate delivery times, and to route your order to the nearest kitchen.
  • Source: collected from you, or from your device where you have granted location permission. You can withdraw this permission at any time through your device settings.

Customer support information

  • Examples collected: the contents of your messages, calls, or chats with our support team, and any photographs or order details you share with a complaint.
  • Purpose: to provide customer support, resolve order issues, and process refunds or replacements.
  • Source: collected from you.

2. Minors

The Site is not intended for individuals under the age of 18 years. We do not knowingly collect Personal Information from children. In accordance with the Digital Personal Data Protection Act, 2023, we do not process the personal data of children in any manner likely to cause detrimental effect on their well-being, and we do not undertake tracking, behavioural monitoring, or targeted advertising directed at children. If you believe a child has provided us with Personal Information, please contact us and we will delete it.

3. Using Personal Information

We use your Personal Information to provide our services to you, which include: offering food products and meal plans for sale, processing payments, preparing and delivering your orders, handling refunds and complaints, improving our menu and service, and — where you have consented — keeping you up to date on new products, offers, and services.

4. Lawful Basis and Consent

For users in India. We process your Personal Information under the Digital Personal Data Protection Act, 2023, principally on the basis of your consent, and for certain legitimate uses permitted by that Act — including where you have voluntarily provided your data for a specified purpose, and where processing is necessary to comply with a legal obligation. Where consent is the basis, you may withdraw it at any time (see Section 9).

For users in the European Economic Area. Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the EEA, we process your Personal Information under the following lawful bases:

  • your consent;
  • the performance of the contract between you and EatFitGo;
  • compliance with our legal obligations;
  • to protect your vital interests;
  • to perform a task carried out in the public interest;
  • for our legitimate interests, which do not override your fundamental rights and freedoms.

5. Sharing Personal Information

We share your Personal Information only as necessary to run our business, including with:

  • Delivery partners and riders — your name, delivery address, phone number, and delivery instructions, so your order can reach you.
  • Payment gateways and banks — to process your payment. We do not store full card numbers on our systems.
  • Cloud hosting, IT, and analytics providers — who process data on our behalf under contract.
  • Marketing and communication platforms — where you have opted in to receive our communications.
  • Food safety authorities and regulators — where required, including in connection with our FSSAI obligations.
  • Legal and law enforcement authorities — where we are required to do so by law, or to respond to a lawful request, or to protect our rights.

We do not sell your Personal Information.

6. Behavioural Advertising

We use Personal Information to deliver targeted advertisements or marketing communications we believe may be of interest to you. For example:

You can unsubscribe from our marketing emails and SMS at any time using the unsubscribe link or by replying STOP. Transactional messages about an order in progress will still be sent.

7. Allergen and Nutrition Information

Where you tell us about an allergy, intolerance, or dietary restriction, we pass that information to our kitchen and packaging teams and make reasonable efforts to honour it. However, our kitchens handle a wide range of ingredients — including milk, nuts, soy, wheat, eggs, fish, and shellfish — and we cannot guarantee that any dish is entirely free of traces of a given allergen. If you have a severe allergy, please contact us before ordering. Nutrition and calorie figures shown on the Site are estimates based on standard recipes and may vary between batches.

8. Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase it. We retain order, invoice, and payment records for as long as required under applicable tax, accounting, food-safety, and company-law obligations in India — typically eight years — after which they are deleted or anonymised. Dietary preference information is retained for as long as your account remains active.

9. Your Rights

Depending on where you reside, you may have the right to:

  • access the Personal Information we hold about you and a summary of how it is processed;
  • correct, complete, or update inaccurate or incomplete information;
  • erase your Personal Information, subject to our legal retention obligations;
  • withdraw consent at any time, where processing is based on consent. Withdrawing consent does not affect processing already carried out, and may mean we can no longer deliver certain services to you;
  • nominate another individual to exercise your rights in the event of your death or incapacity, as provided under the Digital Personal Data Protection Act, 2023;
  • grieve — to raise a grievance with us about how we handle your data, and to escalate to the Data Protection Board of India if you are not satisfied with our response.

If you are a resident of the EEA, you additionally have the right to data portability, the right to restrict or object to processing, and the right to lodge a complaint with your local supervisory authority.

10. Automated Decision-Making

If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (including profiling) where that decision-making has a legal effect on you or otherwise significantly affects you.

We do not engage in fully automated decision-making that has a legal or otherwise significant effect using customer data. Our payment processors use limited automated decision-making to prevent fraud, which does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:

  • temporary denylisting of IP addresses associated with repeated failed transactions, persisting for a small number of hours;
  • temporary denylisting of payment cards associated with denylisted IP addresses, persisting for a small number of days.

11. Data Security

We maintain reasonable technical, administrative, and physical safeguards designed to protect your Personal Information against unauthorised access, disclosure, alteration, or destruction. These include encryption of data in transit, access controls limiting staff access to what their role requires, and contractual security obligations on our processors. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. In the event of a personal data breach, we will notify you and the Data Protection Board of India as required under applicable law.

12. Cookies

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site.

We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as your login, cart contents, and delivery pin code). This means you don’t have to re-enter this information each time you return to the Site or move from one page to another. We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices, or for other operational, legal, or regulatory reasons.
